Business courts are part of a movement towards judicial specialization. In business and commercial cases, there is a perception that specialized courts make conducting business in that region more attractive, predictable and reliable. Business courts are also believed to reduce litigation costs for the parties and the court system. However, some fear that this creates a two-tiered system of justice for businesses and individuals that is biased toward businesses and against individuals or consumers. This panel will discuss the current business cases docket route in Nevada's Second and Eighth Judicial Districts, including the types of cases which qualify to be heard by Nevada's three business court judges, the benefits of our current system to business entities and the State's economy and the limitations of our current system. The panel will also compare and contrast our current business court system, where appropriate, to those of other states, discuss the advantages and disadvantages of creating a dedicated business court or other statewide court of limited jurisdiction for Nevada as well as provide an overview of recent legislative action in this area.
