The United States Court of Appeals for the Ninth Circuit will hold a special sitting February 27 at the William S. Boyd School of Law on the campus of the University of Nevada at Las Vegas. Oral arguments will be heard in the Thomas & Mack Moot Court Facility, beginning at 10 a.m. A photo ID will be required to enter the courtroom.
An appellate panel consisting of Chief Judge Alex Kozinski of Pasadena and Circuit Judges Marsha S. Berzon of San Francisco and Jay S. Bybee of Las Vegas will consider appeals of three cases decided by the federal trial court for the District of Arizona. The cases on the docket are:
United States v. Kincaid-Chauncey, in which Mary Kincaid-Chauncey, a former Clark County commissioner, appeals her jury conviction for conspiracy, fraud and bribery. Case 06-10544.
Borodkin v. Omni Air International, in which pilot John Borodkin appeals a summary judgment in favor of Omni Air in his action claiming wrongful discharge and defamation stemming from his positive test on a random FAA alcohol test and Omni's statement to a prospective employer that he had tested positive. Case 06-17007.
United States v. Flaherty, in which Diana Flaherty appeals her jury conviction for fraud and money laundering arising out of a fraudulent scheme to dupe investors based on the false premise that she and her co-conspirators had a proprietary technology to extract precious metals from volcanic cinders. Case 07-10138.
This is the court’s first sitting at UNLV and first use of the Thomas & Mack Moot Court Facility, which was dedicated in December. The state-of-the-art teaching facility includes a courtroom and a 100-seat auditorium in which legal education, legal argument simulation activities, and court proceedings can occur.
The Ninth Circuit Court of Appeals hears appeals of cases decided by federal trial courts in nine western states and two Pacific Island jurisdictions. The court regularly hears cases in San Francisco, Pasadena, Portland and Seattle, and also travels periodically to other cities within the circuit to hold court.
